Donald Trump needs to be tried for his crimes. Since the Senate refuses to do it, it’s time to take him to a court of law.

The President might think his is above the law, but there is one Constitutional Amendment that even he cannot escape: the Disqualification Clause of the 14th Amendment.

This clause was written with traitors just Trump him in mind.

After the end of the Civil War, the Union passed a number of Reconstruction Acts to ensure the Confederacy would not be able to re-assume power. One of these Acts, the 14th Amendment, contains a clause that was written to prevent Confederates and other traitors from seeking reelection.

The Disqualification Clause reads:

“No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.”

In more modern terms, if a public official gave aid or comfort to our enemies (Russia, for example) or if they rebelled against the Constitution (by, say, abusing their power and obstructing justice), they can be disqualified from running for re-election.

But only if we take Trump to court.

Trump needs to be held accountable for his crimes. And he needs to be prevented from using the office of the Presidency to aid our enemies and disband the Constitution.

As the Senate refused to do its duty and hold a fair trial, it’s time for the court to step up.
